An in-hand payment is different. Federal law requires a 20 percent mandatory withholding on the eligible rollover portion of any lump sum paid to the member rather than rolled (source: IRS Publication 575). How is an OCERS withdrawal taxed in California?

What you give up by withdrawing

This is the part a sales pitch will rush past. An OCERS withdrawal is not a free transfer of value. You are trading a guaranteed lifetime benefit, plus disability and survivor coverage, for a one-time lump sum that is usually smaller than the pension it replaces.

The forfeiture is plain in the OCERS wording. If you withdraw your contributions, you will no longer be eligible for any benefits from the System. The account structure is legitimate and IRS-sanctioned. The risk is rarely the account. It is the sales pitch attached to it.

A federal court found the firm convinced over 950 people to buy coins worth about $30 million for roughly $69 million. A balanced look has to name when this works against you. For many OCERS members, withdrawing contributions to fund a gold IRA is the wrong move, and saying so plainly is part of an honest guide.

It is usually a bad idea in these situations:

  • You are still in OCERS-covered employment. Active members cannot withdraw or borrow against contributions, so the rollover route is not available to you yet. Plan timing carefully before you separate.
