SEP IRA to Gold IRA for Self-Employed Californians

What a SEP IRA is, and why it can roll to a gold IRA

A SEP IRA is a Simplified Employee Pension under Section 408(k) of the Internal Revenue Code. It is a traditional IRA on the receiving side. Only the employer contributes; the employee never makes salary-reduction deposits to a SEP set up after 1996 (source: IRS Publication 560).

For a self-employed person, the employer and the employee are the same individual. You wear both hats. Your business contributes to your own SEP IRA, and the contribution is reported on Schedule 1 (Form 1040), line 16 (source: IRS Publication 560).

The IRS treats a SEP IRA as a traditional IRA for rollover purposes. The 2025 IRS Rollover Chart confirms a direct move from a SEP IRA to a Traditional IRA is allowed with no tax, and the same is true for a move to another SEP IRA (source: IRS Rollover Chart).

A self-directed precious-metals IRA at an IRS-approved nonbank trustee is a traditional IRA in legal form. That is why a SEP IRA balance can be moved to a self-directed gold IRA: federally, it is a traditional-to-traditional trustee-to-trustee transfer.

Who qualifies as self-employed for a SEP IRA in California

The IRS rule is the same nationwide: a SEP can be set up by a business of any size, including a self-employed person (source: IRS Simplified Employee Pension page). For California self-employed taxpayers, the relevant categories are sole proprietors filing Schedule C, sole-owner partners receiving Schedule K-1, and single-member LLC owners taxed as disregarded entities.

The key tax concept is net earnings from self-employment. Publication 560 defines this as net profit from Schedule C, Schedule F, or the partnership Schedule K-1 box 14 code A, reduced by one-half of self-employment tax and by the SEP contribution itself (source: IRS Publication 560).

If you have common-law employees besides yourself, a SEP IRA forces uniform contributions for everyone who meets the plan's eligibility test. The default Form 5305-SEP test is age 21, at least three of the prior five years of service, and $800 in compensation in 2026 (source: IRS Form 5305-SEP).

Common-law employees are not self-employed. If you are an independent contractor of one company that issues you a Form 1099-NEC, you are still self-employed for SEP purposes as long as you are running your own trade or business.

2025 and 2026 SEP IRA contribution limits

The IRS dollar caps reset every year. For 2025, the maximum SEP contribution for any participant was the lesser of 25% of compensation or $70,000, and only the first $350,000 of compensation counted (source: IRS Publication 560).

For 2026, the IRS cost-of-living adjustment lifts both ceilings. The maximum contribution rises to $72,000, and the annual compensation ceiling rises to $360,000 (source: IRS COLA increases table).

The minimum compensation that triggers coverage of an employee under the default Form 5305-SEP rules is $800 for 2026, up from $750 for 2025. That figure matters only if you have employees beyond yourself.

The self-employed 20% net-earnings math

The headline 25% number does not apply to your own SEP IRA contribution if you are self-employed. Pub 560 spells out the catch: your "compensation" is net earnings from self-employment, and net earnings depend on the SEP contribution and the one-half SE tax deduction (source: IRS Publication 560, chapter 2).

To resolve the circularity, the IRS provides a Rate Table for Self-Employed in chapter 5. At the maximum 25% plan rate, the self-employed effective rate is 0.200000, or 20% of net earnings (source: IRS Publication 560, Rate Table).

The order of operations matters. First, you compute net profit on Schedule C, F, or K-1. Second, you subtract one-half of self-employment tax. Third, you multiply the result by 20%. That product is your maximum deductible SEP contribution at the 25% plan rate.

How to open a SEP IRA and roll it to a self-directed gold IRA

Two distinct steps can be separated by a single day or by many years. First, fund the SEP IRA at any custodian that accepts SEP plans. Second, move the balance to a self-directed gold IRA when you are ready. Both steps follow IRS-defined paperwork.

  1. Adopt a SEP plan document. Sign IRS Form 5305-SEP as your own employer if you have no other qualified plan, or use a prototype document from your custodian (source: IRS Form 5305-SEP).
  2. Open the SEP IRA account. Any IRS-approved custodian can hold the SEP IRA, since it is just a traditional IRA bucket on the receiving side. Provide a copy of the signed plan document.
  3. Contribute by the tax-return deadline. Contributions for a tax year can be made through the due date of your return, including extensions (source: IRS SEP plan page).
  4. Open a self-directed IRA for the metal. Pick a custodian that handles precious metals. The custodian holds legal title to the account and handles IRS reporting (Form 5498 for contributions, Form 1099-R for distributions).
  5. Request a direct trustee-to-trustee transfer. Ask your SEP IRA custodian to send the cash or eligible assets directly to the new self-directed IRA. No money is paid to you, and no 60-day clock starts.
  6. Pick the metal and the depository. Once the cash lands inside the self-directed IRA, you choose IRS-approved bullion or coins, and the approved depository takes physical possession to keep the account compliant (source: 26 U.S.C. Section 408).

Trustee-to-trustee transfers between IRAs are NOT counted under the one-rollover-per-12-months IRA aggregation rule, per IRS Pub 590-A. Indirect (60-day) rollovers are. We explain that distinction next.

Direct rollover versus the 60-day rule and the 20% withholding trap

How the money moves decides how much of it survives the move. There are two paths, and only one is safe in practice.

A direct trustee-to-trustee transfer is the route to use. The SEP IRA custodian sends the funds straight to the new self-directed IRA. No tax is withheld, no 60-day clock starts, and the move does not count toward the one-rollover-per-12-months IRA aggregation rule (source: IRS Publication 590-A).

An indirect 60-day rollover is different. The SEP IRA pays you a check, and you have 60 days to redeposit it into another IRA. Miss the window, and the full amount becomes a taxable distribution. The 10% federal additional tax can apply if you are under age 59 1/2 with no qualifying exception.

The harder trap is mandatory federal withholding on certain indirect rollovers. IRA-to-IRA indirect rollovers do not trigger the 20% mandatory withholding that employer plans face, but optional withholding of 10% federal can still apply unless you opt out on Form W-4R. Use a direct trustee-to-trustee transfer and the question never comes up.

How a SEP IRA to gold IRA rollover is taxed in California

A direct trustee-to-trustee transfer is not a taxable event for federal or California purposes. The money never enters your hands, so there is nothing to report as income that year. California has no separate state-level rollover penalty.

The California tax questions arise only if you take a SEP IRA distribution in hand instead of rolling it. A distribution paid to you flows through federal AGI, then onto your California return via Schedule CA (540) (source: California FTB, Early distributions).

California has nine statutory brackets topping at 12.3%, plus a 1% Mental Health Services Tax on income over $1,000,000, for a top combined marginal rate of 13.3% (source: California Revenue & Taxation Code; FTB Schedule X).

The early-withdrawal stack before age 59 1/2

Age changes the math sharply. If you take a SEP IRA distribution in hand before age 59 1/2 and do not roll it over, the IRS imposes a 10% additional tax on top of ordinary income tax (source: IRS Publication 590-B).

California adds 2.5% of its own on the same amount, with the FTB 3805P exception list mirroring most of the federal exceptions (source: FTB Form 3805P instructions). Combined, that is 12.5% in penalty tax before any ordinary income tax applies.

A direct trustee-to-trustee transfer into a self-directed gold IRA avoids the whole stack. Nothing is distributed to you, so no early-distribution tax applies. Consult your tax advisor for your specific situation.

IRS rules for the gold IRA itself

Once your SEP IRA dollars land inside a self-directed gold IRA, the account follows the same federal rules as any traditional IRA. Four points matter most.

Only IRS-approved metals qualify. The recognized minimum fineness is gold .995, silver .999, and platinum or palladium .9995, drawn from commodity-market delivery standards (source: 26 U.S.C. Section 408). American Gold and Silver Eagles qualify under a separate carve-out for U.S.-minted coins.

A licensed custodian must hold the account. The custodian is a bank or an IRS-approved non-bank trustee that holds legal title and handles reporting. You direct the choices, but the custodian administers the account.

Required Minimum Distributions begin at age 73 under SECURE 2.0 for those born 1951 to 1959, and at age 75 for those born 1960 or later starting in 2033 (source: IRS Publication 590-B). SEP IRAs follow the same RMD rules as traditional IRAs.

SEP IRA versus Solo 401(k) for California self-employed

A SEP IRA is not the only retirement plan a self-employed Californian can use. A Solo 401(k) (also called an individual 401(k)) is the main alternative. Both can roll into a self-directed gold IRA after separation from the business or at retirement, but the math during the working years differs.

At modest net earnings, a Solo 401(k) usually allows a larger total contribution because the elective deferral does not depend on net earnings. At higher net earnings, the two converge at the same total dollar cap.

For a self-employed Californian with $40,000 of net profit, a Solo 401(k) lets you contribute roughly $24,500 (employee deferral) plus about $7,400 (profit-sharing at 20% of net earnings minus half SE tax), versus a SEP cap of about $7,400 alone. What fees a gold IRA carries

A gold IRA costs more to run than an index fund, and a small SEP IRA balance feels those costs more than a large one. Knowing the line items up front protects you.

Expect a one-time setup fee, an annual custodian fee, and an annual storage fee paid to the depository. On top sits the dealer's spread, the gap between what you pay for metal and what it would sell for on the same day. The spread is usually the largest lifetime cost and the least clearly disclosed.

Because a SEP IRA contribution is capped by the 20% net-earnings rule, a self-employed person's SEP balance often grows in modest annual chunks. Risks, red flags, and how California protects you

The SEP IRA account structure is legitimate and IRS-sanctioned. The gold IRA structure is also legitimate and IRS-sanctioned. The risk is rarely the account. It is the sales pitch attached to it.

California's Department of Financial Protection and Innovation regulates financial-service providers in the state and can take enforcement action, including restitution and penalties (source: DFPI). It has pursued real precious-metals fraud, often in coordination with federal regulators.

In one joint action, Red Rock Secured was ordered to pay more than $56,000,000. A federal court found the firm convinced over 950 people to buy coins worth about $30 million for roughly $69 million. The markups ran between 91.89% and 129.97% (source: CFTC release 8898-24).

If something goes wrong, a Californian can file a complaint with the DFPI online at dfpi.ca.gov, or call the help line at 1-866-275-2677. National banks are handled by the OCC instead. Filing is free and acknowledged quickly.

When rolling a SEP IRA into gold is a bad idea

A balanced look has to name when this works against you. For many self-employed Californians, moving a SEP IRA into gold is the wrong move at this stage, and saying so plainly is part of an honest guide.

It is usually a bad idea in these situations:

  • Your SEP IRA balance is small against the fee drag. Setup, annual custodian, storage, and the dealer spread are largely fixed. On a small SEP balance those costs eat a large share, so a modest holding can struggle to ever come out ahead.
  • You may need the money within a few years. Metal is volatile short-term, and selling means crossing the dealer spread again. Before age 59 1/2 you also stack the 10% federal and 2.5% California additional taxes if you take cash in hand rather than transfer.
  • You have not maxed cheaper retirement vehicles yet. The full federal Roth and traditional IRA contribution limits, plus a possible Solo 401(k), often deliver a larger tax-favored base with lower fees. Order matters; metal can come later.
  • Your business income is volatile. A self-employed earner with a thin emergency fund and irregular pay should keep liquidity higher. Locked-up retirement metal cannot pay rent next month.
  • You plan a backdoor Roth strategy. The Form 8606 pro-rata rule aggregates traditional, SEP, and SIMPLE IRA balances when calculating the taxable portion of a conversion. If one of these describes you, slowing down is the sensible call. The fee drag on small balances and the Form 8606 aggregation rule both punish a hasty SEP-to-gold decision more than most pitches admit.

Does a SEP IRA balance affect my backdoor Roth conversion?

Yes. The Form 8606 pro-rata rule aggregates the December 31 balances of all your traditional, SEP, and SIMPLE IRAs when calculating the taxable portion of any Roth conversion. A large SEP balance can make a backdoor Roth largely taxable. Workplace 401(k) and 403(b) balances are excluded from the aggregation.

Are Roth SEP IRAs allowed now?

Yes. SECURE 2.0 Section 601, effective for tax years beginning after 2022, permits SEP contributions to be made to a Roth IRA if the plan and the custodian support it. A Roth SEP contribution is included in income in the year of contribution, like any Roth contribution. Adoption has been gradual; not every custodian offers it yet.
